They form an integral and essential part of the rental contract concluded, to which they apply without restriction or reservation. <\/p>\n<p>They are systematically notified to the Lessee when booking a boat with the Lessor and are attached to the corresponding rental contract. <strong>Consequently, placing a reservation and signing the rental contract necessarily implies the Lessee&#8217;s full and unreserved acceptance of these terms.<\/strong><\/p>\n<p>The Lessor reserves the right to modify and\/or adapt these terms at any time. In any event, only the version in force on the day the quote is validated is applicable to the Lessee. <\/p>\n<p>The Lessor invites each Lessee to carefully read these Terms, print them, and\/or save them on any durable medium, before concluding any contract with the Lessor.<\/p>\n<ol start=\"2\">\n<li><strong>2- RENTAL CONDITIONS <\/strong><\/li>\n<\/ol>\n<p><strong><u>2.1. Driver&#8217;s Aptitude <\/u><\/strong><\/p>\n<p>Boats can be rented without a navigation license. However, an adult driver must be designated by the Lessee before taking charge of the boat. By default, the Lessee is designated as the driver, unless another crew member is designated.  <\/p>\n<p>The driver is responsible for the boat and the equipment entrusted to them, their crew and\/or any person on board, and declares to be informed of the deadlines and exclusions of guarantees enforceable under the insurance policy applicable to the boat. The driver declares to be fit to operate the boat and undertakes to comply with all instructions and safety and navigation guidelines provided before departure by the Lessor&#8217;s staff, as well as river navigation regulations. <\/p>\n<p>If, after adequate safety instructions and practical advice, the Lessor&#8217;s departure base staff has reason to believe that safe and secure navigation will not be possible, or that the driver is not fit to assume responsibility, the Lessor reserves the right to:<\/p>\n<ul>\n<li>offer a stay at the dock;<\/li>\n<li>limit the navigation area for all or part of the rental period; or<\/li>\n<li>refuse the boat&#8217;s handover, with the driver being solely at fault.<\/li>\n<\/ul>\n<p>It is specified that, for any rental, the crew must consist of at least one (1) adult in good physical condition.<\/p>\n<p><strong><u>2.2. Booking Procedures<\/u><\/strong><\/p>\n<p>Reservations can be made directly on-site or on the Site via our partner&#8217;s platform, Nautic Manager. The Lessee chooses the departure base, date, and time of rental according to the availability indicated by the Lessor. The boat reservation is effective upon receipt of payment and before boarding.  <\/p>\n<ol start=\"3\">\n<li><strong>3- FINANCIAL CONDITIONS<\/strong><\/li>\n<\/ol>\n<p>Boats are rented to the Lessee based on the prices charged by the Lessor, as indicated on the Site. Prices are given in euros, all taxes included (&#8220;TTC&#8221;). They may be revised at any time, it being specified that the price in force is that appearing on the Site at the time of booking.  <\/p>\n<p>Payment of the rental amount is made either via the Nautic Manager platform, it being specified that payment is secured and managed by our partner&#8217;s platform via an approved provider, or on the day of booking before boat departure by cash, credit card, ANCV, or ANCV connect. Payment is due immediately. <\/p>\n<p>If the Lessee does not pay the amounts due for the rental, the Lessor reserves the right to refuse boarding to the Lessee and their crew until payments are regularized.<\/p>\n<ol start=\"4\">\n<li><strong>4- DEPOSIT<\/strong><\/li>\n<\/ol>\n<p>A deposit of three hundred (300) euros must be made by bank imprint at the time of boat reservation and before boarding, and will be returned at the end of the rental provided that:<\/p>\n<ul>\n<li>the boat and all its equipment are returned in good condition, at the agreed time and place;<\/li>\n<li>the boat has not suffered or caused damage to a third party;<\/li>\n<li>all sums due for the rental have been effectively collected.<\/li>\n<\/ul>\n<p>Depending on the boat model, an additional deposit may be requested when taking charge of the boat. In such a case, the Lessee will be informed before any booking confirmation. <\/p>\n<p>The purpose of the deposit is to guarantee payment of costs incurred by deterioration and\/or accidental or voluntary damage caused to or suffered by the boat and\/or its equipment, breakage or loss, even partial, of materials or equipment, poor maintenance of the boat and\/or its equipment during the rental, abandonment or late return of the boat, attributable to the Lessee.<\/p>\n<p>The Lessee shall inform the Lessor and remains responsible for all damages, breakages and\/or loss of elements constituting the boat&#8217;s equipment, the absence or degradation of which, noted during the return inventory, cannot give rise to a claim declaration or be covered by the deposit made at the time of booking, and undertakes to pay the cost of replacement or repair upon the Lessor&#8217;s first request.<\/p>\n<p>It is understood between the parties that the deposit shall not constitute any limitation of liability, and that they retain full power to exercise their rights to pursue any recourse for compensation for the damage suffered.<\/p>\n<ol start=\"5\">\n<li><strong>5- BOAT CONDITION<\/strong><\/li>\n<\/ol>\n<p>The Lessor undertakes to provide the Lessee with a boat equipped and fitted in accordance with current laws and regulations for river navigation.<\/p>\n<p>Furthermore, the Lessor undertakes to provide a boat equipped with all necessary instruments for navigation and safety, namely life jackets and safety instructions.<\/p>\n<ol start=\"6\">\n<li><strong>6- BOARDING AND HANDOVER<\/strong><\/li>\n<\/ol>\n<p>The boat is made available to the Lessee after the completion of the following formalities: payment of the deposit; payment of any remaining sums due; signing of the rental contract.<\/p>\n<p>Taking possession of the boat constitutes acknowledgment by the Lessee of the boat&#8217;s good operating condition and cleanliness.<\/p>\n<p>The boarding location may be from another departure base in the event of an incident making boarding impossible at the location specified in the contract, without this being a cause for cancellation of the rental.<\/p>\n<p>The Lessor reserves the right to refuse boarding if it is found that the number of individuals present at the time of boarding exceeds the maximum authorized capacity on board the rented boat or does not correspond to the reservation. In such a case, the Lessee will not be entitled to any refund or compensation. <\/p>\n<ol start=\"7\">\n<li><strong>7- RETURN OF THE BOAT<\/strong><\/li>\n<\/ol>\n<p>The Lessee undertakes to return the boat to the departure port where said boat was handed over to them, unless otherwise stipulated, on the date and time contractually fixed, except in cases of unforeseeable, irresistible force majeure beyond the driver&#8217;s control. The boat must be returned to the Lessor in the same operating and clean condition in which it was entrusted, with all equipment and materials it contains, in accordance with the contradictory inventory established during boarding, which shall serve as proof if applicable. <\/p>\n<p>In case of delay in returning the boat, the Lessee undertakes to notify the Lessor. The Lessee agrees to report their presence to the Lessor upon return, it being specified that the rental will only end after the return to the agreed place, date, and time. <\/p>\n<p>The Lessor reserves the right to charge the Lessee for all expenses incurred by a late return or abandonment of the boat during the cruise. In this regard, the Lessee is informed that any commenced hour exceeding the rental period will be charged at the current rate, which may be increased by a penalty corresponding to fifty (50)% of the rental price. Any deterioration and\/or damage caused to the boat or to third parties due to the boat will be charged to the Lessee, according to the terms of Article 4 herein.  <\/p>\n<ol start=\"8\">\n<li><strong>8- CANCELLATION AND\/OR MODIFICATION OF THE RESERVATION<\/strong><\/li>\n<\/ol>\n<p><strong><u>8.1. At the Lessee&#8217;s initiative <\/u><\/strong><\/p>\n<p>For whatever reason, in case of cancellation of the reservation, the Lessor will charge the Lessee the following cancellation fees:<\/p>\n<ul>\n<li>For cancellations more than fifteen (15) days before departure: full refund.<\/li>\n<li>For cancellations less than fifteen (15) days before departure: 100% of the rental amount.<\/li>\n<\/ul>\n<p>It is specified that these fees apply in case of complete cancellation of the rental. The cancellation of one or more crew members only, if the cruise is maintained, will not entitle to any refund, as the price is per boat and not per person. <\/p>\n<p><strong>The Lessee is also informed that, in accordance with Article L.221-28 12\u00b0 of the Consumer Code, they do not benefit from the right of withdrawal, concerning the provision, within the framework of these terms, of leisure activity services that must be provided on a specific date or period.<\/strong><\/p>\n<p><strong><u>8.2. At the Lessor&#8217;s initiative<\/u><\/strong><\/p>\n<p>If, due to damage incurred during the previous rental, any impediment beyond its control, or a case of force majeure, the Lessor cannot make the reserved model available to the Lessee on the agreed date and time, the Lessor undertakes to use all available means to provide the Lessee with a replacement boat of equivalent or superior conformity, size, and capacity to the one initially chosen. In case of impossibility, the Lessor will immediately refund all sums paid to the Lessee, excluding any other compensation. In case of current or forecast weather conditions dangerous for the crew&#8217;s safety, the Lessor reserves the right to terminate the contract.  <\/p>\n<ol start=\"9\">\n<li><strong>9- ABANDONMENT OF CRUISE<\/strong><\/li>\n<\/ol>\n<p>In case of abandonment of the boat during the cruise, for whatever reason, except in cases of sustained and prolonged impassability of the waterway, the Lessor retains the amount of the deposit as a lump-sum indemnity, without prejudice to its right to seek compensation for greater damages. Any definitive interruption of the cruise must be notified to the Lessor without delay. The Lessee remains responsible for the boat until its effective return to the return base.  <\/p>\n<ol start=\"10\">\n<li><strong>10- LESSEE&#8217;S OBLIGATIONS AND BOAT USE<\/strong><\/li>\n<\/ol>\n<p>The Lessee undertakes to comply with river navigation regulations, as well as all instructions and safety rules provided by the Lessor and river authorities, and undertakes to use the boat in strict compliance with the environment. The Lessee shall keep a copy of the rental contract throughout the cruise and undertakes to present it to the competent authorities upon request. The Lessee shall inform the Lessor of any lost, broken, stolen, or damaged equipment, and of any event affecting the rental (breakdown, accident, damage).  <\/p>\n<p><strong>For imperative safety reasons, the Lessee is only authorized to navigate in the following areas: The Erdre or the S\u00e8vre, with the exception of all tributaries and the Saint F\u00e9lix tunnel in Nantes. <\/strong>They undertake to strictly respect the authorized navigation zone.<\/p>\n<p>Furthermore, the Lessee is prohibited from: towing, subletting and\/or lending the boat; embarking crew members not planned at the time of boarding and exceeding the maximum number of authorized passengers (including children); having the boat driven by a person other than the designated driver; jumping from the boat; navigating under the influence of alcohol or narcotics; using the boat for purposes other than pleasure navigation, and specifically not using the boat for commercial or professional activities or participating in regattas, races, cruises, or any other competition. The Lessee undertakes to comply with life jacket wearing rules, which are mandatory for minors up to 30 kg and strongly recommended for adult passengers. <\/p>\n<p>Any non-compliance with this article will result in the immediate disembarkation of the Lessee and their crew, it being specified that the costs of repatriating the boat will be borne by the Lessee.<\/p>\n<ol start=\"11\">\n<li><strong>11- BREAKDOWNS<\/strong><\/li>\n<\/ol>\n<p>In the event of a breakdown occurring during the rental period, the Lessee must immediately inform the Lessor and strictly follow the instructions given.<\/p>\n<p>In the event of a breakdown not attributable to the driver, the Lessor will refund the Lessee the amount of the rental, pro rata to the uncompleted rental time, excluding any other compensation. Neither a boat replacement nor an extension of the rental period can be guaranteed. <\/p>\n<p>In the event of a boat breakdown attributable to the Lessee, they shall not be entitled to any compensation for the deprivation of enjoyment, and the Lessor reserves the right to charge them for the repair costs incurred, in accordance with the terms of Article 4 herein, without prejudice to damages.<\/p>\n<ol start=\"12\">\n<li><strong>12- ACCIDENT AND DAMAGE<\/strong><\/li>\n<\/ol>\n<p>In the event of an accident or damage occurring during the rental period, whatever its nature, the Lessee is required to immediately report it to the Lessor, and to the competent authorities if applicable. The Lessee undertakes to follow any instructions given by the Lessor and shall under no circumstances attempt to have the boat repaired without having obtained the Lessor&#8217;s prior consent. <\/p>\n<p>The Lessee undertakes to complete and sign the claim forms, obtain the signature of any third parties and witnesses, and provide the Lessor with a detailed report of the accident or damage and all useful information, documents, and testimonies.<\/p>\n<p>Except for accidents resulting from an inherent defect of the vessel, and in accordance with Article 2.1 herein, the driver remains personally and fully responsible for the consequences of an accident whose origin falls under an exclusion mentioned in Article 14 herein or for which the civil or criminal liability of a crew member is sought without involving the boat or its equipment. In this regard, the Lessee undertakes not to acknowledge any responsibility, conclude any amicable agreement, or make any declaration engaging the Lessor or its insurer, without the Lessor&#8217;s prior written consent. <\/p>\n<p>It is understood that the driver, whether causing or being a victim of an accident, cannot claim any compensation if their cruise is thereby compromised. The financial consequences of an accident, including repair costs, assistance, towing, salvage, immobilization of the boat, as well as insurance deductibles and damages not covered by the deposit and insurance guarantees, remain the responsibility of the Lessee, within the limits provided by applicable regulations and the stipulations of the contract. <\/p>\n<ol start=\"13\">\n<li><strong>13- BOAT INSURANCE<\/strong><\/li>\n<\/ol>\n<p>The boats are insured in accordance with current river navigation regulations.<\/p>\n<p>They are notably insured for accidental damage, third-party claims due to the boat, accidental pollution; in case of a claim, the driver remains financially responsible up to the amount of the deposit, except for forfeiture or exclusions below where they remain liable for the full repair of damages. Fines and criminal penalties are always excluded from insurance coverage. The driver and all persons on board, their personal effects, as well as their own civil liability are not covered by this insurance; the driver and their crew may take out individual insurance for their benefit and at their expense to cover these risks. Breakage or loss of materials and\/or equipment, poor maintenance of the boat, are not covered by this insurance.   <\/p>\n<p><strong>Excluded from the boats&#8217; insurance coverage<\/strong> are damages, losses, third-party claims, and expenses resulting from intentional or inexcusable fault, deliberate breach of safety or navigation rules, violation of navigation bans or restrictions, towing, acts of any crew member ashore, unlawful use of the boat or its equipment, driving while intoxicated, under the influence of narcotics or substances, even medicinal, affecting consciousness or reaction capacity, use of the boat for purposes other than personal leisure, exceeding the number of passengers authorized by the Lessor, navigation outside authorized areas, false declarations, as well as all malicious acts committed with the complicity of any person on board.<\/p>\n<p>The driver, their crew, and their personal effects are not covered by the Lessor&#8217;s insurance.<\/p>\n<ol start=\"14\">\n<li><strong>14- LIABILITY<\/strong><\/li>\n<\/ol>\n<p>The Lessee assumes, throughout the rental period, the legal and material custody of the boat within the meaning of Article 1242 of the Civil Code. As such, the Lessee is solely responsible for any material, bodily, or immaterial damage caused directly or indirectly to the boat, its equipment, crew members, and\/or third parties from the time the boat is taken over until its return. The Lessor cannot under any circumstances be held responsible for direct or indirect, material, bodily, or immaterial damages suffered by the Lessee and\/or by third parties due to the use of the boat during the rental, except in cases of gross negligence or breach of its obligation to deliver a compliant boat.  <\/p>\n<p>The Lessee alone is responsible to the competent authorities for any prosecutions, fines, and confiscations incurred during the rental, even in the event of unintentional fault on their part. In the event of seizure of the rented boat, without confiscation, the Lessee will be required to pay the Lessor a contractual immobilization indemnity corresponding to the current rental rate. In the event of confiscation of the rented boat, the Lessee will be required to reimburse the value of the boat within one (1) month.  <\/p>\n<p>The Lessor cannot be held responsible for losses and\/or damages caused in any way whatsoever to the personal effects of the Lessee and their crew members.<\/p>\n<ol start=\"15\">\n<li><strong>15- IMPASSABILITY OF THE WATERWAY<\/strong><\/li>\n<\/ol>\n<p>The Lessor cannot be held responsible, in case of interruption or limitation of the cruise according to the itinerary provided in the contract, resulting from the closure of waterways for technical reasons or administrative police reasons, strikes, floods, low water levels, inundation or drought and other bad weather, as well as any other circumstance beyond its control making navigation impossible or difficult. Under these conditions, the Lessor may modify the places, dates, and times of departure or return of the cruise. If these same events make the entire cruise impossible, the sums paid by the Lessee will be credited towards a subsequent trip to be agreed between the parties, the Lessor not being obliged to refund. Any temporary interruption of the cruise does not give rise to compensation.   <\/p>\n<ol start=\"16\">\n<li><strong>16- FORCE MAJEURE <\/strong><\/li>\n<\/ol>\n<p>Neither party shall be held liable to the other for the non-performance or delays in the performance of an obligation arising from these Terms that would be due to the act of the other party following the occurrence of a case of force majeure, within the meaning of Article 1218 of the Civil Code. A case of force majeure suspends the obligations arising from these Terms for the duration of its existence, and neither party may, during this period, validly invoke the existence of such a case of force majeure within the meaning of Article 1218 of the Civil Code to justify the termination of its contractual relationship with the other party. However, in the event of force majeure lasting more than thirty (30) consecutive days, either party may terminate the contract by right, after sending a registered letter with acknowledgment of receipt notifying this decision.  <\/p>\n<ol start=\"17\">\n<li><strong>17- PERSONAL DATA PROTECTION<\/strong><\/li>\n<\/ol>\n<p>The Lessee is informed that the booking of a boat, and more broadly the execution of the contract binding them to the Lessor, leads to the collection and processing by the Lessor of personal data concerning them, the use of which is subject to the provisions of Law No. 78-17 of January 6, 1978, known as the Data Protection Act, as amended, and European Regulation 2016\/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the &#8220;<strong>GDPR<\/strong>&#8220;). Personal data is collected in accordance with the Privacy Policy, available on the Site at the URL <a href=\"https:\/\/www.location-bateaux-electriques.com\/en\/privacy-policy\">https:\/\/www.location-bateaux-electriques.com\/politique-de-confidentialite<\/a>, which describes the principles of collection and processing of personal data practiced by the Lessor, as well as the rights that the Lessee has regarding their data, which they can exercise at any time: <\/p>\n<ul>\n<li>by email to the address: <a href=\"mailto:info@rubanvert.fr\">info@rubanvert.fr<\/a><\/li>\n<li>by mail to the postal address: RUBAN VERT SARL, 20 \u00cele de Versailles, 44 000 Nantes.<\/li>\n<\/ul>\n<ol start=\"18\">\n<li><strong>18- APPLICABLE LAW AND COMPETENT JURISDICTION<\/strong><\/li>\n<\/ol>\n<p>These Terms are subject to French law. In the event of a dispute concerning these Terms, the Lessee may refer the matter to one of the territorially competent courts under the Code of Civil Procedure, or the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event. <\/p>\n<p>In accordance with Article L.612-1 of the Consumer Code, it is reminded that the Lessee has the right to free recourse to a mediator.
